The Bombay High Court has held that a divorced woman cannot use her former husband’s name (19 Feb 2010).

In an order passed early this week, the High Court directed a woman to refrain from using husband’s name and surname. Earlier, Principal judge of the family court in Mumbai had restrained the woman, Asha, from using her ex-husband Ramesh’s name and surname as their marriage had ended four years ago. Court granted divorce to Asha and Ramesh (both names changed) in 2006. but when Asha filed application for maintenance, Ramesh took a stand that she was still using his name and surname, and urged the family court to restrain her from doing so. he alleged that she was misusing his name, was posing as his wife, and putting him in embarrassing situations.
Asha argued that since she had challenged divorce in the Supreme Court, where her appeal was still pending, she was still his wife. The family court held that the marriage had come to an end and she could not use husband’s name any longer. Asha then filed appeal in the High Court.
Such is the abysmal state of affairs in India…….. ! now I’d like to know -
1. anybody would hold dear, one’s own name. So, why would a lady change her name upon getting married? where did such an idea originate from?
2. what does the man stand to gain by having his wife change her name (and even surname), to that of his (or his parent’s) choice? Would you call such a man, just and fair?
3. If she was made to change her name at the time of marriage, is it justified (by order of the court or otherwise) that upon being divorced, she change back to her maiden name? does anyone care for this hapless woman, who is once again left with no identity of her own? where does it put such a woman in the society?
4. do you think that such a name change is necessary, or even should be permitted…….at all, in our society today, where women have reached every nook and cranny that man once monopolized?
Many more painful questions come to mind. but I’ll stop here. Would like the answerers to ponder over the issues raised and reply. There has to be some getaway………….
